Candidate Privacy Notice – United States

The Rocket Family of Companies retains and processes a range of personal information, some of which relates to the individuals who apply to work for us. This Privacy Notice includes details about the personal information we process about job applicants and other individuals who apply to work for the Family of Companies and third parties whose information is provided to us in connection with the application, such as references (collectively, “Candidates,” “you,” or “your”).

If you accept an offer from us, we will process further information from you in your capacity as a team member (i.e., employee) or contractor, described in further detail in our Team Member Privacy Notice (provided as part of the on-boarding process).

Where we refer to “employment” or “engagement” in this Privacy Notice, we do so for convenience only, and this should in no way be interpreted as purporting to confer employment status on non-employees to whom this Notice applies. This Notice does not form part of any contract of employment or engagement, does not confer any employment status or contractual right on any Candidate or place any contractual obligation on us.

APPLICABILITY OF OTHER POLICIES

This Privacy Notice does not cover information collected about you as a Rocket client or user of Rocket-affiliated websites, mobile apps, or other Rocket products or services. To learn more about our information practices in those situations, please read our Rocket Family of Companies Privacy Policy.

In some cases, you may provide personal information to third parties with whom we work. By providing your information to these third parties, you understand that your personal information is governed by separate privacy policies which are not under our control. Please contact such third parties for questions regarding their privacy practices.

NOTICE OF PERSONAL INFORMATION COLLECTED

We collect, and have collected in the preceding 12 months, the following categories of personal information:

Internet or other similar network activity

Computer or cell phone-related data, such as access points and times.

Geolocation data

Such as information concerning your whereabouts, including geolocation information.

Sensory data

Audio, visual, or similar information, such as cameras, closed-circuit television, and phone call or video conferencing recordings when you interact with our recruiters or other personnel or visit our office locations.

Professional or employment-related information

Such as your resume, cover letter, employment history, licensures, education, skillsets, accolades received, pre-hire assessment, references, criminal or credit history, background check information, information provided by references, results of background checks, and our assessment of such pre-hire information.

Education information

Such as your degrees and academic records.

Inferences drawn from other personal information

Assessments and inferences drawn from any of the information identified above.

“Sensitive” Personal Information

Such as, for example, your Social Security number, driver’s license, state identification card, passport number, racial or ethnic origin, or other categories of “sensitive personal information” as that term is defined by California Law.

HOW WE COLLECT YOUR INFORMATION

We collect information you provide directly to us, information that we obtain from third parties, and information about you that we develop during our interaction with you.

Generally, we collect personal information directly from you in circumstances where you provide it (e.g., when you apply to work for us or otherwise provide us with such information). We may also collect personal information automatically, such as when monitoring the use of our premises, equipment, devices, computers, network, applications, software, or similar assets and resources. We may also obtain personal information from your previous employers or educational institutions, third-party service providers (e.g. background screening companies), your named references, legal bodies and publicly accessible sources such as your LinkedIn profile and other social media platforms.

HOW WE USE PERSONAL INFORMATION/BUSINESS PURPOSES

We use personal information about you related to the assessment of your application, in compliance with our legal obligations, in the legitimate interests of the Family of Companies, and where we otherwise have your consent. These purposes include:

  1. Administering the application process and assessing your skills, qualifications, and suitability for the position, including information verification.
  2. Conducting pre-employment background checks and reference checks.
  3. Carrying out legal duties and regulatory compliance functions.
  4. Conducting consultations or negotiations directly or through representatives.
  5. Maintaining your application record for current and future hiring processes, including to communicate with you and providing you with information regarding potential career opportunities.
  6. Monitoring and action programs to ensure equal employment opportunity.
  7. Marketing and promotional opportunities.
  8. To provide you with further potential employment or engagement opportunities with our business partners.
  9. As otherwise related to your application to work for one of the Rocket Family of Companies.

Please note that your demographic and other protected status information, such as race, gender, or age, is not used for any employment-related purpose that affects the terms and conditions of your potential employment or engagement. 

HOW WE DISCLOSE YOUR PERSONAL INFORMATION

 We may disclose personal information in certain circumstances, including: to comply with our legal obligations; to protect the rights and property of our customers and the public; to detect and respond to suspected illegal activity and threats to the health or safety of any person or of our systems or services; to maintain our business operations, including, for example, by providing or enabling our service providers, professional advisors, and other similar entities to assist with the administration of communication platforms and facilitate internal programs relating to diversity, inclusion, and anti-discrimination; and with your consent or at your direction. We may also disclose aggregated or de-identified information, which cannot reasonably be used to identify you. We process, maintain, and use this information only in a de-identified fashion and will not attempt to re-identify such information except as permitted by law.

ADDITIONAL INFORMATION REGARDING YOUR STATE PRIVACY RIGHTS

CALIFORNIA PRIVACY RIGHTS AND CHOICES

Subject to certain limitations, if you are a resident of California, then you have the right to (1) request to know more about the categories and specific pieces of personal information we collect, use, disclose and sell, and to access your information, (2) request deletion of your personal information, (3) request correction of your personal information and (4) not be discriminated against for exercising these rights.

You may make these requests by starting a request online or calling 888-444-7492. We’ll verify your request by asking you to provide information related to your recent interactions with us.

If we receive your request from an authorized agent, we may ask for evidence that you’ve provided such agent with a power of attorney, or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. If you’re an authorized agent seeking to make a request, please contact us as set out above.

Any request to exercise one of these rights will be assessed by us on a case-by-case basis. There may be circumstances in which we are not legally required to comply with your request because of a relevant legal exemption provided for under applicable law. We will not discriminate or retaliate against you for exercising your privacy rights.

 SALE, SHARING, AND USE OF PERSONAL INFORMATION

California requires certain disclosures related to the use, sale, or sharing of personal information. Rocket does not “sell” or “share” your personal information as those terms are defined under California law. We do not have any knowledge of any “sales” or “sharing” of the personal information of minors under 16 years of age. And Rocket does not use or disclose your sensitive personal information for purposes other than those expressly permitted by California law.

DATA RETENTION

The length of time we retain your personal information depends on the status of our relationship with you and the requirements of applicable law. We will retain your personal information for as long as your engagement with us lasts, and for a certain period thereafter, after which point it will be deleted or archived in accordance with applicable law. To determine that period, we take into account a number of factors including our legal and regulatory obligations (such as financial reporting obligations and equal opportunity or anti-discrimination reporting obligations) and whether we may need to retain personal information to resolve disputes, make and defend legal claims, conduct audits, pursue legitimate business purposes and/or enforce our agreements.
